In the underlying case, the trial court signed a protective order, and Appellant filed a notice of appeal challenging the order.
Acting pro se, Appellant filed a Statement of Inability to Afford Payment of Court Costs, and the court reporter filed a challenge. See Tex.R.Civ.P. 145(e)(1).
The trial court held a hearing on the challenge, and it denied Appellant's request for a free record on appeal. See Tex. R. Civ. P. 145(f). Its order was dated January 3, 2024.
On January 26, 2024, Appellant's retained counsel filed (1) a motion to challenge the trial court's order, see Tex. R. Civ. P. 145(g)(1), and (2) a motion for an extension of time to file the challenge, see Tex. R. Civ. P. 145(g)(2).
Appellant's motion for an extension of time to file the challenge is granted. Appellant's challenge is deemed timely filed. See id.
We order the court reporter and the trial court clerk to prepare and file in this court, within fifteen days of the date of this order, records of all the trial court's proceedings on Appellant's ability to afford payment of court costs. See Tex. R. Civ. P. 145(g)(3). "The record[s] must be provided without charge." Id.
All other appellate deadlines remain suspended pending further order of this court.
