The clerk's record was due on November 27, 2023. Three days later, the Bexar County District Clerk filed a notice of late record stating Appellant had not paid for the record.
Simultaneously, Appellant filed in this court a Statement of Inability to Afford Payment of Court Costs, which had been filed in the trial court on August 29, 2023.
On November 30, 2023, we noted that Appellant had filed a Statement, which excused him from paying for the clerk's record, and we set the clerk's record due on December 11, 2023.
On December 1, 2023, the staff attorney for the Bexar County Civil District Courts filed a letter notifying this court that a "Motion to Require the Appellant to Prove the Inability to Afford Costs" was filed on October 20, 2023, and a hearing on the Statement was set for December 11, 2023, at 9:00 am. See Tex. R. Civ. P. 145(f) (hearing on Statement).
Also on December 1, 2023, court reporter Amanda Plano filed a notice of late record. She requested an extension of time to file the reporter's record until after the hearing on Appellant's Statement.
The court reporter's request is granted. We vacate and withdraw our November 30, 2023 order, and we suspend the deadlines to file the clerk's and reporter's records. We order the Bexar County District Clerk to file a status report regarding the Statement challenge not later than January 10, 2024
