Upon consideration, respondent's motion to re-transmit the record on appeal in case no. 3D10–1700 is hereby denied as unnecessary.

Following review of the petition for writ of habeas corpus alleging ineffective assistance of appellate counsel and the response thereto, it is ordered that said petition is hereby denied.
