Ramos v. State

District Court of Appeal of Florida, Third District
Jun 14, 1994
637 So. 2d 14 (Fla. Dist. Ct. App. 1994)

Opinion

No. 94-471.

May 10, 1994. Rehearing Denied June 14, 1994.

An Appeal under Fla.R.App.P. 9.140(g) from the Circuit Court for Dade County; W. Thomas Spencer, Judge.

Rene S. Ramos, in pro. per.

Robert A. Butterworth, Atty. Gen., for appellee.

Before BARKDULL, JORGENSON and GODERICH, JJ.

Rene Ramos appeals from the denial of his motion to correct an illegal sentence. Because the record before the trial court and this court is devoid of any indication that defendant filed such a motion, we affirm without prejudice to the defendant filing a motion which the trial court can determine on the merits.
