This case is on the calendar of the Court's April 24, 2023 trial session for New York City, New York. Respondent filed a Status Report on March 31, 2023, and advised that a basis for settlement has been reached. Further, the report states that respondent's counsel is awaiting the tax computations in order to prepare and send to petitioner the proposed decision document reflecting the settlement. Upon due consideration, it is

ORDERED that this case is stricken from the above-referenced trial session, and the parties are excused from appearing at the calendar call on April 24, 2023. It is further

ORDERED that, on or before June 23, 2023, the parties shall file a proposed stipulated decision. It is further

ORDERED that jurisdiction of this case is retained by the undersigned.
