District Court of Appeal of Florida, Third District
Dec 21, 1993
627 So. 2d 621 (Fla. Dist. Ct. App. 1993)

Opinion

No. 93-1173.

December 21, 1993.

An Appeal under Fla.R.App.P. 9.140(g) from the Circuit Court for Dade County; Arthur Maginnis, Judge.

Bennett H. Brummer, Public Defender, and Bruce A. Rosenthal, Asst. Public Defender, for appellant.

Robert A. Butterworth, Atty. Gen., and Richard L. Polin, Asst. Atty. Gen., for appellee.

Before JORGENSON, LEVY and GERSTEN, JJ.

Ramirez appeals from the trial court's denial of his motion for post conviction relief. We reverse and remand for further proceedings. The record indicates that the trial court summarily denied Ramirez' motion without the presence of the attorney whom the court had previously appointed to represent him in his 3.850 motion.

Reversed and remanded.
