Decision
Claimant moves to settle the record on appeal.
Claimant filed and served a Notice of Appeal from a Decision and Order of this Court denying his motion for summary judgment. The Decision and Order from which the claimant appeals, dated February 14, 2019, denied claimant's motion for summary judgment except to the limited extent of dismissing the defendant's first affirmative defense asserted in its answer.
The Court has reviewed the motion papers claimant asserts comprise the record on appeal and agrees that all of the papers considered in rendering the Decision and Order from which claimant appeals are included in the claimant's proposed record (see CPLR 5526). The Appellate Division Rules also require that a table of contents be included in the record as well as a copy of this Decision and Order settling the record (22 NYCRR 1250.7 [b] [3], [7]).
Accordingly, claimant's motion is granted and the record is settled in accordance herewith.
