An appeal having been taken from an order of the Supreme Court, New York County, entered on or about March 09, 2021, and said appeal having been perfected, And respondent-respondent having moved to dismiss the appeal based on the inclusion of improper documents in the record or, in the alternative, to strike the record and brief, to direct petitioner to file a new record and brief, and to adjourn the appeal, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is granted to the extent of striking the portions of petitioner-appellant's record which include post-order documents. Petitioner is directed to file a substitute brief for the January 2022 Term of this Court, to which Term the appeal is adjourned, which omits references to such documents, and which complies with 22 NYCRR 1250.8(b)(3).
