ANDREA RAMBERT AND KENDRICK WASHINGTON, Appellants v. NOB HILL WEST LLC DBA NOB HILL WEST, Appellee
On Appeal from the County Civil Court at Law No. 1 Harris County, Texas
Trial Court Cause No. 1091965
MEMORANDUM OPINION
Appellants, Andrea Rambert and Kendrick Washington, proceeding pro se, have failed to timely file their appellate brief. See TEX. R. APP. P. 38.6(a), (d), 38.8(a)(1). After being notified by the Clerk of this Court on September 20, 2017, that this appeal was subject to dismissal for want of prosecution for failure to file the appellants' brief within ten days of that notice, appellants failed to timely respond. See id. 38.6(d), 38.8(a)(1), 42.3(b), (c).
On November 10, 2017, the district clerk filed a notice in this Court stating that after it had mailed the clerk's record to the appellants on September 26, 2017, it was returned to the district clerk on November 10, 2017, marked as: "RETURN TO SENDER[,] ATTEMPTED — NOT KNOWN [,] UNABLE TO FORWARD." Appellants neither timely filed their brief nor provided the Clerk of this Court with any other address. See TEX. R. APP. P. 9.1(b) ("A party not represented by counsel must sign any document . . . and give the party's mailing address, telephone number, fax number, if any, and email address."); 38.8(a)(1), 42.3(c).
Accordingly, we dismiss the appeal for want of prosecution for failure to timely file a brief. See TEX. R. APP. P. 38.8(a)(1), 42.3(b), (c).
PER CURIAM Panel consists of Chief Justice Radack and Justices Higley and Bland.
