DECISION & ORDER ON MOTION

Application by the petitioner-appellant for leave to make a fourth motion for leave to reargue an appeal from an order and judgment (one paper) of the Supreme Court, Kings County, dated March 9, 2009, which was determined by decision and order of this Court dated October 18, 2011. After the determination of the appeal, the petitioner-appellant made three motions, inter alia, for reargument of the appeal. The branches of his motions which were for reargument were denied by decisions and orders on motion of this Court dated December 21, 2011, February 21, 2012, and April 6, 2012, respectively. The decision and order on motion dated April 6, 2012, also granted that branch of the cross motion of the respondent-respondent which was to preclude the petitioner-appellant from making further motions without prior leave of this Court. Thereafter, prior to the instant application, the petitioner-appellant made 12 applications for leave to make a fourth motion for leave to reargue the appeal, each of which has been denied.

Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the application is denied; and it is further,

ORDERED that on the Court's own motion, the petitioner-appellant is enjoined from making any further motions or applications in connection with the above-entitled appeal.
