Appeal from a judgment sustaining a demurrer.
The case of Knorr v. Bates, 33 N.Y.S. 691, is an authority on the question presented by the demurrer and binding upon this court, notwithstanding the more liberal view taken by Judge INGRAHAM in Leitner v. Beecher.
Demurrer sustained, with costs.
