Order of the County Court of Orange County granting, upon certain conditions, the defendant's motion to dismiss the plaintiff's complaint for lack of prosecution, modified on the facts by striking therefrom everything following the words "with costs to the defendant." As so modified, the order is affirmed, with ten dollars costs and disbursements to defendant. No adequate explanation of the cause of the delay in going forward with the trial of the case is contained in the respondent's papers. Hagarty, Carswell, Adel, Taylor and Close, JJ., concur.
