RAJI v. BANK SEPAHIRAN

Court of Appeals of the State of New York
Nov 21, 1989
74 N.Y.2d 916 (N.Y. 1989)

Opinion

Submitted August 7, 1989

Decided November 21, 1989

Motion to dismiss appeal granted and appeal dismissed, without costs, upon the ground that no substantial constitutional question is directly involved. On the court's own motion, cross appeal dismissed, without costs, upon the ground that plaintiffs, having stipulated to reducing the amount of damages to which they are entitled, are not aggrieved by the modification for purposes of appeal (see, CPLR 5511; Smith v Hooker Chem. Plastics Corp., 69 N.Y.2d 1029; Dudley v Perkins, 235 N.Y. 448).
