District Court of Appeal of Florida, Second District
Apr 12, 1996
686 So. 2d 10 (Fla. Dist. Ct. App. 1996)

Opinion

No. 95-03407.

April 12, 1996.

Appeal from the Circuit Court for Pinellas County; David Seth Walker, Judge.

William D. Slicker of William D. Slicker, P.A., St. Petersburg, for Appellant.

Robert A. Butterworth, Attorney General, Tallahassee, and Jeanne Clougher, Assistant Attorney General, Tampa, for Appellee.

Billie Jean Rains seeks review of the trial court's order dismissing her motion to set aside the order distributing sale proceeds. We affirm the trial court's dismissal of the motion without prejudice to Rains' right to seek enforcement of her equitable lien, if any, in an appropriate proceeding against the subject property.

CAMPBELL, A.C.J., and ALTENBERND and QUINCE, JJ., concur.
