In an action on an employment contract, alleged to have been entered into by the corporate defendant, performance of which was guaranteed by the individual defendant, the defendants appeal from an order denying a motion to vacate a notice for their examination before trial. Order affirmed, with $10 costs and disbursements; the examination to proceed on five days' notice. No opinion. Carswell, Acting P.J., Johnston, Adel, Wenzel and MacCrate, JJ., concur.
