ORDER

This case was called and recalled for trial on October 23, 2023, at the Trial Session of the Court in New York, New York. Petitioner, Logan L. Raicovich and counsel for respondent appeared and were heard. At recall, Frank Agostino from the New York County Lawyers' Association Calendar Call Program entered an appearance on behalf of petitioners. On October 13, 2023, counsel for respondent filed with the Court a Motion to Dismiss for Lack of Prosecution. Counsel for petitioner made an Oral Motion for Continuance to obtain additional documentation. There was no objection by counsel for respondent.

Upon due consideration, and for cause, it is

ORDERED that respondent Motion to Dismiss for Lack of Prosecution filed with the Court on October 13, 2023, is denied as moot. It is further

ORDERED that petitioner's Oral Motion for Continuance is granted and jurisdiction of the case is retained by this Division of the Court. It is further

ORDERED that on or before January 23, 2024, the parties shall submit proposed stipulated decision documents or a joint status report stating the-then present status of this case.
