ORDER DENYING PETITION

This is a proper person petition for a writ of mandamus. Petitioner seeks an order of this court directing court-appointed counsel to file a supplemental post-conviction petition for a writ of habeas corpus and directing the district court to hold an evidentiary hearing. We have reviewed the documents submitted in this matter, and without deciding upon the merits of any claims raised therein, we decline to exercise original jurisdiction in this matter. The district court's records indicate that it has ordered the post-conviction habeas petition taken off calendar and that counsel could have it reset. We are confident that the district court will place the petition back on calendar and resolve the matter as expeditiously as its calendar permits. Accordingly, we

ORDER the petition DENIED.
