This case was calendared for trial at the Court's November 4, 2024, Washington D.C., trial session. On August 9, 2024, respondent filed a Motion for Summary Judgment. On October 4, 2024, respondent filed a Motion for Continuance. By Order served October 15, 2024, respondent's Motion for Summary Judgment was set for hearing at the Court's above-referenced trial session. On November 1, 2024, petitioners filed a Motion to Proceed Remotely.
When this case was called from the calendar on November 4, 2024, counsel for the parties appeared and were heard. At that time, petitioners' counsel withdrew petitioners' Motion to Proceed Remotely and made an oral Motion for Continuance of the hearing with respect to respondent's Motion for Summary Judgment. Respondent objected and was heard. Upon due consideration and for cause more fully appearing in the transcript of the proceeding, it is
ORDERED that respondent's Motion for Continuance of the trial of this matter, filed October 4, 2024, is granted, and this case is continued. It is further
ORDERED that petitioners' oral Motion for Continuance of the hearing on the pending motion for summary judgment, made November 4, 2024, is granted, in that respondent's Motion for Summary Judgment, filed August 9, 2024, is taken under advisement. It is further
ORDERED that petitioners' Motion to Proceed Remotely, filed November 1, 2024, is denied as moot. It is further
ORDERED that on or before February 3, 2025, the parties shall file with the Court a written report (joint or separate) advising as to the then present status of the case. It is further
ORDERED that jurisdiction of this case is retained by the undersigned.
