Radio City Entertainment v. Redland Ins. Co.

United States District Court, S.D. New York
Feb 4, 2002
02 Civ. 0737 (LAK) (S.D.N.Y. Feb. 4, 2002)

Opinion

02 Civ. 0737 (LAK).

February 4, 2002

ORDER

In this purported diversity action, the complaint fails adequately to allege the citizenship of any of the plaintiffs. See, e.g., Carden v. Arkoma Associates, 494 U.S. 185, 195-96 (1990) (a partnership is a citizen of every state of which each of its partners, general or limited, is a citizen).

The complaint therefore is dismissed for lack of subject matter jurisdiction with leave to amend to cure the jurisdictional defect provided the amended complaint is filed no later than February 12, 2002.

SO ORDERED.
