Order reversed, without costs, and motion granted upon payment of all costs to date, and upon condition that defendant stipulate that plaintiff may discontinue his action, without costs, if he is so advised. Jenks, P.J., Thomas, Carr, Rich and Putnam, JJ., concurred.
