OPINION


This action was commenced by the filing of the complaint on February 4, 1998. The case was originally assigned to Judge Knapp of this court. On June 26, 2000 Judge Knapp issued an order directing defendant to answer the complaint. On October 20, 2000 the Corporation Counsel's office wrote Judge Knapp stating that defendant had never been served. A copy of that letter was sent to plaintiff at his last known address. The letter was returned undelivered.

The case was recently transferred to the undersigned. The Corporation Counsel's office has written a letter dated February 1, 2002 requesting that the case be dismissed for lack of prosecution.

The application is granted and the action is dismissed with prejudice for lack of prosecution.

SO ORDERED.
