ORDER AFFIRMING MAGISTRATE JUDGE'S REPORT AND DISMISSING WITHOUT PREJUDICE COMPLAINT PURSUANT TO 42 § 1983
THIS CAUSE is before the Court upon Plaintiff Albert Quinn's complaint pursuant to 42 U.S.C. § 1983, filed June 14, 2005. [DE #1]
THE MATTER was referred to the Honorable Patrick A. White, United States Magistrate Judge for report and recommendation. [DE #2] On August 9, 2005, the Magistrate Judge filed a Report and Recommendation concluding that the petition be dismissed without prejudice. [DE #4] No objections to the Report and Recommendation were filed. The matter is ripe for disposition.

ORDERED AND ADJUDGED that the Magistrate Judge's Report and Recommendation filed August 9, 2005 is RATIFIED, AFFIRMED AND ADOPTED. It is further
ORDERED AND ADJUDGED that Albert Connery Quinn's complaint pursuant to 42 U.S.C. § 1983 is DISMISSED WITHOUT PREJUDICE. It is also
ORDERED AND ADJUDGED that any other pending motion is DISMISSED as moot.
