ORDER OF PARTIAL DISMISSAL


For the reasons stated in the Preliminary Report of the Magistrate Judge, and upon independent review of the file, it is thereupon

ORDERED AND ADJUDGED as follows:

1. The Defendant Wilson is dismissed as a party to this action pursuant to 28 U.S.C. § 1915(e)(2)(B)(ii) for failure to state a claim upon which relief may be granted.
2. The claims concerning violation of plea agreement and tampering with medical records are dismissed pursuant to 28 U.S.C. § 1915(e)(2)(B)(ii) for failure to state a claim upon which relief may be granted.
3. The request for injunctive relief in the form of instituting criminal charges is denied.
4. The case shall remain pending against the Defendants Jackson and Ramirez on the claim of excessive force insofar as the plaintiff seeks monetary damages.
DONE AND ORDERED.
