ORDER

BILL PEDERSEN, III JUSTICE

Before the Court is appellee's September 21, 2022 letter stating that appellant's September 21, 2022 Emergency Motion for Temporary Relief includes an exhibit that contains material that appellee had designated as "Confidential" pursuant to a July 22, 2021 "Order and Confidentiality Agreement." By order dated October 6, 2022, we temporarily sealed the emergency motion and its exhibits, giving the parties twenty days to obtain a proper rule 76a order from the trial court that permitted the filing of the documents under seal and to supplement the record with a copy of that order.

On October 26, 2022, appellee filed an Agreed Order on Motion to Seal Court Records dated October 25, 2022, wherein the trial court granted appellee's request to permanently seal the following court records under Texas Rule of Civil Procedure 76a:

a. Cigniti's Technologies, Inc.'s client list, contained in Exhibit "1" to Defendants' Motion to Suspend Enforcement of Temporary Injunction Order During Appeal, filed in the 101st District Court on October 18, 2022, and Exhibit "G" to Appellant[s'] Emergency Motion for Temporary Relief, filed in the Court of Appeals for the Fifth District of Texas on September 21, 2022.
b. Cigniti Technologies, Inc.'s prospective client list, contained in Exhibit "1" to Defendants' Motion to Suspend Enforcement of Temporary Injunction Order During Appeal, filed in the 101st District Court on October 18, 2022, and Exhibit "G" to Appellant[s'] Emergency Motion for Temporary Relief, filed in the Court of Appeals for the Fifth District of Texas on September 21, 2022.

The trial court ordered, among other things, "that the documents listed above are immediately and permanently under seal of the court."

Accordingly, we GRANT appellee's request and direct the Clerk of the Court to place appellant's September 21, 2022 Emergency Motion for Temporary Relief, including its exhibits, under seal.
