Opinion

Case No. 96-3079

Opinion filed July 11, 1997

Appeal from the Circuit Court for Orange County, Reginald Whitehead, Judge.

James B. Gibson, Public Defender, and Brynn Newton, Assistant Public Defender, Daytona Beach, for Appellant.

Robert A. Butterworth, Attorney General, Tallahassee, and Bonnie Jean Parrish, Assistant Attorney General, Daytona Beach, for Appellee.

We affirm the conviction and sentence in this case but must strike the imposition of a lien for the payment of a fee to the public defender. If due notice and an opportunity to be heard are given to appellant, then the court may assess a fee and impose a lien.

AFFIRMED in part.

DAUKSCH, SHARP, W., and PETERSON, JJ., concur.
