This case is calendared for trial at the Trial Session of the Court set to commence on January 23, 2023, in Dallas, Texas.

On January 13, 2023, respondent filed with the Court a Status Report. Therein Respondent's Counsel informed the Court that while she had not received a Court ordered response to Respondent's Motion for Summary Judgment dated November 23, 2022 (see Order dated December 2, 2022), she did receive a document titled Motion to Dismiss from Petitioner on December 28, 2022. The motion was attached to the Status Report and labeled as Exhibit A.

The Court notes that Petitioner is a paper rather than electronic filer and is unsure at this time whether the motion to was also filed by mail and is en route to the Court. It has not yet been received by the Court. Given this development and to allow time for Petitioner's motion to be processed or clarified, the Court will, on its own initiative, continue the case and retain jurisdiction.

Upon due consideration, and for cause, it is

ORDERED that this case is stricken for trial from the Court's January 23, 2023, Trial Session in Dallas, Texas and continued. It is further

ORDERED that jurisdiction of this case is retained by this Division of the Court.
