Judgment and order reversed and new trial granted, with costs to appellant to abide event, upon the ground that the recovery is excessive, unless the plaintiff stipulates to reduce the damages to $250, in which case the judgment is so modified and as modified judgment and order unanimously affirmed, without costs.
