Opinion

CASE NO. 04cv184-BEN (AJB).

September 14, 2005

ORDER ADOPTING REPORT AND RECOMMENDATION DENYING PETITION FOR A WRIT OF HABEAS CORPUS

Petitioner HENRY PUCKETT has filed a petition for a writ of habeas corpus ("Petition") under 28 U.S.C. § 2254, seeking relief from his 1999 robbery and weapons convictions. On October 26, 2004, United States Magistrate Judge Anthony J. Battaglia issued a Report and Recommendation, recommending the Petition be denied in its entirety. The Report and Recommendation thoroughly and correctly considered Petitioner's claims and determined that the claims do not warrant federal habeas relief. Although Petitioner filed Objections to the Report and Recommendation, the Objections are general in nature reiterating claims already made and considered. No new claims are identified; no new facts are presented. Nevertheless, this Court has made a de novo review of the Report. See, 28 U.S.C. § 636(b). Good cause appearing, the Court accepts and adopts the Report in whole. Accordingly, the Petition is DENIED in its entirety. The Clerk shall close the file.

IT IS SO ORDERED.
