MEMORANDUM OPINION


On November 2, 2001, we remanded this case to the trial court for further proceedings in accordance with the settlement reached between the parties, and abated this appeal until a motion to reinstate was filed alleging the settlement had failed, a motion to dismiss was filed, or until December 31, 2002. No motion to reinstate or motion to dismiss has been filed in this case and December 31, 2002 has passed.

Accordingly, pursuant to our November 2, 2001 Order, we DISMISS this appeal. See Tex.R.App.P. 42.1(a)(1). Costs are taxed against the appellants. See Tex.R.App.P. 42.1(d).
