On February 27, 2023, counsel for respondent filed a Motion to Dismiss for Failure to Properly Prosecute. This case was called from the calendar at the March 20, 2023, Cincinnati, Ohio, remote Trial Session of the Court. Richard Kruse appeared and was specially recognized to represent the petitioner. At calendar call, petitioner made an Oral Motion for Continuance. Counsel for respondent appeared and did not object to petitioner's oral motion.
