  1. N.Y.C. Transit Auth. v. Hill

    107 A.D.3d 897 (N.Y. App. Div. 2013)   Cited 9 times

Here, the NYCTA established, prima facie, the untimeliness of Hill's demand for arbitration with evidence that he served the demand on May 10, 2012, more than 7 1/2 years after the subject accident on September 28, 2004 ( see Jenkins v. State Farm Ins. Co., 21 A.D.3d at 530, 801 N.Y.S.2d 42;Matter of State Farm Mut. Auto. Ins. Co. v. Avena, 133 A.D.2d 159, 161, 518 N.Y.S.2d 678). At that point, the burden shifted to Hill to come forward with evidence of an accrual date later than the date of the accident ( see Matter of Progressive Northeastern Ins. Co. v. Rogers, 90 A.D.3d 666, 668, 934 N.Y.S.2d 451;Jenkins v. State Farm Ins. Co., 21 A.D.3d at 530, 801 N.Y.S.2d 42;Matter of Allstate Ins. Co. v. Morrison, 267 A.D.2d 381, 700 N.Y.S.2d 74). On the record before us, Hill failed to satisfy his burden of establishing an accrual date later than the date of the accident ( see Jenkins v. State Farm Ins. Co., 21 A.D.3d at 530, 801 N.Y.S.2d 42;Matter of Allstate Ins. Co. v. Morrison, 267 A.D.2d at 382, 700 N.Y.S.2d 74;Matter of State Farm Mut. Auto. Ins. Co. v. Avena, 133 A.D.2d at 161, 518 N.Y.S.2d 678).

  2. Gov't Emps. Ins. Co. v. Monaco

    2019 N.Y. Slip Op. 30484 (N.Y. Sup. Ct. 2019)

Similarly, all parties agree Monaco did not demand uninsured motorist benefits until 2018, some seven years after the accident. The burden, therefore, shifts to Monaco to come forward with evidence of an accrual date later than the date of the accident (see New York City Tr. Auth. v Hill, 107 AD3d 897, [2d Dept 2013], Progressive Northeastern Ins. Co. v Rogers, 90 AD3d 666 [2d Dept 2011]). Monaco argues the accrual date should be April 12, 2018, the date on which the jury returned its verdict in the Kings County Action. Monaco reasons the verdict date judicially determined the issue of insurance coverage.
