ORDER
This 20th day of September 2001, it appears to the Court that:
(1) The appellant, Ronald E. Proctor, Jr., is the plaintiff in a personal injury action in the Superior Court. Proctor has petitioned this Court, pursuant to Supreme Court Rule 42, to accept an interlocutory appeal from a Superior Court bench ruling entered on August 1, 2001, that required Proctor to file an amended complaint within 20 days. The Superior Court also directed Proctor to refile other handwritten filings that the Court found difficult to read. By order dated August 31, 2001, the Superior Court denied Proctor=s application to certify the interlocutory appeal.
It appears from the Superior Court record that Proctor filed the amended complaint on August 21, 2001.
(2) Applications for interlocutory review are addressed to the sound discretion of this Court and are accepted only in exceptional circumstances.
Supr. Ct. R. 42(b).
In the exercise of its discretion, the Court has concluded that the application for interlocutory review does not meet the requirements of Supreme Court Rule 42 and should be refused.
NOW, THEREFORE, IT IS HEREBY ORDERED that the interlocutory appeal is REFUSED.
