Prock v. State

District Court of Appeal of Florida, Second District
Jul 16, 1997
696 So. 2d 1293 (Fla. Dist. Ct. App. 1997)

Opinion

Case No. 95-04353

Opinion filed July 16, 1997.

Appeal from the Circuit Court for Hillsborough County; Claudia R. Isom, Judge.

James Marion Moorman, Public Defender, and Jeffrey M. Pearlman, Assistant Public Defender, Bartow, for Appellant.

Robert A. Butterworth, Attorney General, Tallahassee, and Ronald Napolitano, Assistant Attorney General, Tampa, for Appellee.

Ruth Bates Prock pleaded nolo contendere to the manufacture of cannabis and was sentenced to eighteen months probation. We have reviewed this case according to our obligation under In re Anders Briefs, 581 So.2d 149 (Fla. 1991), and affirm Prock's judgment. We strike from her sentence, however, the $2 cost imposed pursuant to section 943.25(13), Florida Statutes (1993), because it was not orally imposed at the sentencing hearing. See Reyes v. State, 655 So.2d 111, 117 (Fla. 2d DCA 1995).

Affirmed as modified.

SCHOONOVER, A.C.J., and LAZZARA and QUINCE, JJ., Concur.
