ORDER ADMINISTRATIVELY CLOSING DOCKET NO. 59130, AMENDING CAPTION IN DOCKET NO. 59091, AND GRANTING MOTION FOR EXCESS PAGES IN DOCKET NO. 59091
The matter in Docket No. 59091 was originally docketed in this court as an original petition for a writ of mandamus. On August 31, 2011, this court directed petitioner in Docket No. 59091 to file a notice of appeal challenging the district court's order appointing a receiver and stated that the writ petition would be construed as a motion for stay. Petitioner timely complied with that order. On September 6, 2011, the notice of appeal was inadvertently docketed as a new matter, Docket No. 59130, rather than in Docket No. 59091. Accordingly, we direct the clerk of this court to transfer the documents filed in Docket No. 59130 to Docket No. 59091 and to administratively close Docket No. 59130. In addition, we direct the clerk to amend the caption in Docket No. 59091 to the form for an appeal, in conformity with the caption on this order. Petitioner and real parties in interest in Docket No. 59091 will hereafter be referred to as appellant and respondents.
Appellant has filed a motion for leave to file a reply with excess pages. We grant the motion and direct the clerk to file the proposed reply, provisionally received on September 6, 2011.
