RUSSELL JOE PRITCHETT, JR., Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 397th Judicial District Court Grayson County, Texas Trial Court Cause No. 070743.

ORDER

NANCY KENNEDY, JUSTICE.

We REINSTATE this appeal.

We abated this appeal for the trial court to make findings and recommendations regarding the failure of appellant's counsel, Kristen Brown, to timely file appellant's brief. The trial court held a hearing with Ms. Brown present on September 13, 2024, and the trial court filed findings and recommendations with this Court on September 16, 2024. The trial court recommends allowing the brief to be filed on or before October 15, 2024.

Appellant's brief was originally due more than a year ago. Ms. Brown stated at the September 13, 2024 hearing, "I am done with the record review. I am in the middle of briefing. I'm about 30 pages in right now. So I anticipate being done with it in the next couple of weeks. But there is a lot going on right now, so I would ask for maybe a recommendation of 30 days."

We accept the trial court's recommendation, and we ORDER Kristen Brown to file appellant's brief on or before OCTOBER 15, 2024. We caution Ms. Brown that should she fail to file appellant's brief by October 15, 2024, the Court will utilize whatever remedies it has available, including ordering her removed from representing appellant in this appeal.
