Decision
This is a motion for late claim relief pursuant to Court of Claims Act (CCA) § 10 (6) filed by an inmate of the Upstate Correctional Facility. One seeking late claim relief must attached a copy of the proposed claim. Contrary to the statement in the proposed claimant's affidavit sworn to December 30, 2015, there is no proposed claim attached to or provided in the instant motion.
Additionally, the document annexed to the proposed claimant's motion as a notice of intention to file a claim does not comport with the requirements of Court of Claims Act § 11-b.
Therefore, the motion is denied.
