Opinion
97 Civ. 9415 (WK)
December 5, 2000
Pamela Hayes, New York, NY, for Plaintiff.
Joseph Baumgarten, Proskauer Rose LLP, New York, NY, for Defendant.
ORDER
Plaintiff Marilyn Pressley (the "plaintiff") commenced this employment discrimination action against defendant Mount Sinai Medical Center (the "defendant") in or about December 1997. In October 2000, plaintiff's counsel informed defendant and this Court that plaintiff had decided to abandon the case, i.e., that she was no longer interested in either prosecuting or settling the case because the entire matter was "beneath her dignity." Plaintiff has since refused to talk to her lawyer and did not attend an October 30 conference that we held for the purpose of determining whether to dismiss the case. She has not opposed apparent, however, that such dismissal is exactly the result she desires.
Absent such dismissal, this case will simply linger on our docket in an endless purgatory, to the detriment of the Court, defendant, and (apparently) plaintiff herself.
Accordingly, we hereby GRANT defendant's motion to dismiss the Complaint for failure to prosecute. The Clerk of Court is directed to close this case.
SO ORDERED.
