Opinion

No. 92-3004.

October 29, 1993. Rehearing Denied November 30, 1993.

Appeal from the Circuit Court for Volusia County; John V. Doyle, Judge.

Richard S. Graham, Landis, Graham, French, Husfeld, Sherman Ford, P.A., Daytona Beach, for appellants.

Harlan L. Paul, James, Zimmerman Paul, DeLand, for appellee First Community Bank of Orange City.

David A. Monaco, Monaco, Smith, Hood, Perkins, Loucks Stout, Daytona Beach, for appellees Earl Abbott and Abb-Hitt Corp.

Because the facts, pleadings and briefs are so similar to Boucher v. First Community Bank, 626 So.2d 979 (Fla. 5th DCA 1993), we affirm the summary judgments entered in favor of First Community Bank of Orange City and Earl Abbott but reverse the summary judgment entered in favor of Abb-Hitt Corporation. We remand for further proceedings.

AFFIRMED IN PART; REVERSED IN PART; REMANDED.

PETERSON, GRIFFIN and THOMPSON, JJ., concur.
