ORDER

JUAN F. VASQUEZ, JUDGE

This case is before the Court on respondent's motion to dismiss for failure to properly prosecute, filed on October 19, 2021. The Court conducted a hearing on respondent's motion on November 15, 2021, at the remote Trial Session of the Court for cases in which Los Angeles, California, was the place of trial. Counsel for respondent appeared and presented argument in support of the motion. There was no appearance by or on behalf of petitioner.

During the hearing the Court indicated that it would grant respondent's motion to dismiss for failure to properly prosecute. However, upon further consideration, it would be helpful for the Court to know the date petitioner's corporate powers, rights and privileges were suspended by the State of California.

The foregoing considered, it is

ORDERED that respondent's motion for failure to properly prosecute, filed on October 19, 2021, is held in abeyance. It is further

ORDERED that jurisdiction is retained by the undersigned. It is further

ORDERED that, on or before December 17, 2021, respondent shall file a supplement to his motion to dismiss specifying the date of petitioner's suspension.
