PREMIEANT INCORPORATED DBA PREMIEANT, Appellants v. Constance SNOWDEN as next Friend and Legal Guardian of Annette Snowden, an incapacitated Person, Appellees

From the 224th Judicial District Court, Bexar County, Texas
Trial Court No. 2018CI14231
The Honorable Mary Lou Alvarez, Judge Presiding

ORDER

On April 17, 2019, Appellant Premieant Inc. d/b/a Premieant filed its notice of appeal. On April 25, 2019, Mary Scopas, the court reporter responsible for preparing the reporter's record in this appeal, filed a notification of late record, stating that the record has not been filed because (1) appellant has failed to request in writing that she prepare the reporter's record; and (2) appellant has failed to pay or make arrangements to pay the fee for preparing the reporter's record. See TEX. R. APP. P. 34.6(b)(1) (explaining that the request to the court reporter must designate the exhibits and the portions of the proceedings to be included in the reporter's record); id. 35.3(b) (court reporter is responsible for preparing reporter's record if appellant has requested the reporter's record be prepared, and the party responsible for paying for the preparation of the reporter's record has paid the reporter's fee or has made satisfactory arrangements with the reporter to pay the fee).

We ORDER Appellant Premieant Inc. d/b/a Premieant to file written proof to this court on or before May 17, 2019 that it has requested the official court reporter to prepare the reporter's report in compliance with Texas Rule of Appellate Procedure 34.6 and has filed a copy of the request with the trial court clerk. See id. 34.6(b)(2). We further ORDER Appellant Premieant Inc. d/b/a Premieant to file written proof in this court on or before May 17, 2019 that it has paid or made satisfactory arrangements to pay the fee for preparing the reporter's record.

If appellant fails to respond within the time provided, appellant's brief will be due within thirty days from the date of this order, and the court will only consider those issues or points raised in appellant's brief that do not require a reporter's record for a decision. See TEX. R. APP. P. 37.3(c).
