JUDGMENT


In accordance with this court's Order entered this date, it is ORDERED, ADJUDGED, and DECREED that this action be and is hereby DISMISSED with prejudice. Plaintiffs to bear costs.

ORDER ADOPTING THE REPORT AND RECOMMENDATION OF THE MAGISTRATE JUDGE

After due and proper consideration of all portions of this file deemed relevant to the issues raised, and a de novo determination of those portions of the Report and Recommendation to which objection is made, the Report and Recommendation of the Magistrate Judge made under 28 U.S.C. § 636 (b)(1)(B), and dated February 21, 2001 (doc. 22), is hereby ADOPTED as the opinion of this court.

Accordingly, it is ORDERED that defendant's Motion to Dismiss pursuant to Fed.R.Civ.P. 12(b)(1)(2) and (5) be and is hereby GRANTED and that this action be dismissed with prejudice.
