Prado v. State

District Court of Appeal of Florida, Second District
Apr 7, 2000
755 So. 2d 178 (Fla. Dist. Ct. App. 2000)

Opinion

No. 2D98-503.

Opinion filed April 7, 2000.

Appeal from the Circuit Court for Lee County; Isaac Anderson, Jr., Judge.

James Marion Moorman, Public Defender, and John C. Fisher, Assistant Public Defender, Bartow, for Appellant.

Robert A. Butterworth, Attorney General, Tallahassee, and Susan D. Dunlevy, Assistant Attorney General, Tampa, for Appellee.

Valentine C. Prado appeals the trial court's denial of his dispositive motion to suppress and his sentence under the 1995 sentencing guidelines. This appeal was stayed pending the supreme court's ruling in Heggs v. State, 25 Fla. L. Weekly S137 (Fla. Feb. 22, 2000). However, on January 9, 2000, Mr. Prado completed his prison sentence and was released. The sentencing issue is thus moot. We affirm without further discussion the denial of Mr. Prado's motion to suppress.

Affirmed.

PATTERSON, A.C.J., and ALTENBERND and CASANUEVA, JJ., Concur.
