ORDER
Before the Court are appellant's May 13, 2020 motion to abate and extend time and May 18, 2020 motion to supplement the reporter's record. In the motions, appellant contends that State's Exhibit 14, a videotape recording of appellant's approximately twelve-hour interview, has a five-hour gap in the middle. Specifically, appellant notes that a gap exists between 5:39 a.m. and 10:57 a.m.
The reporter's record on file at the Court contains a State's Exhibit 14 which begins at 2:20 a.m. and ends at 5:39 a.m. In addition, the record contains State's Exhibit 14A-1 (beginning at 10:57 a.m. and ending at 12:44 p.m.); State's Exhibit 14A-2 (beginning at 2:20 a.m. and ending at 5:39 a.m.) and State's Exhibit 14A-3 (beginning at 2:20 a.m. and ending at 2:42 a.m.). There is no video of any interview from 5:39 a.m. to 10:57 a.m.
We GRANT appellant's motions as follow. We ORDER court reporter Julie C. Vroom to file a supplemental reporter's record containing State's Exhibit 14 in its entirety WITHIN TEN DAYS of the date of this order. We ORDER appellant's brief due FORTY-FIVE DAYS after the date the supplemental reporter's record containing the complete copy of State's Exhibit 14 is filed.
We DIRECT the Clerk to send copies of this order to the Honorable Keli Aiken, Presiding Judge, 354th Judicial District Court; Julie Vrooman, official court reporter, 354th Judicial District Court; and to counsel for all parties.
