CRAIG PATRICK POWER, Appellant v. BRADEN RICHARD POWER, Appellee
On Appeal from the 134th Judicial District Court Dallas County, Texas
Trial Court Cause No. DC-15-14415
ORDER
The reporter's record in this appeal is incomplete. By order entered April 20, 2020, we directed court reporter LaToya R. Young to file, no later than April 30, 2020, the reporter's record of the trial proceeding held February 28, 2019. We noted in our order that appellant had requested and paid for the record of that proceeding shortly after the proceeding was held, and the record was apparently prepared by early June 2019 but "the file was corrupt." We also noted that Ms. Young had filed the reporter's record of a November 2017 proceeding on April 14, 2020, almost three months after it was first due, but had made no mention of the outstanding record. In light of the circumstances, we cautioned Ms. Young that extensions would not be granted absent exigent circumstances and failure to comply could result in the Court taking such action as was necessary to ensure the record was filed, including an order that she not sit as a court reporter until she complied.
Rather than filing the record, Ms. Young requested an extension to May 8, 2020. We granted the short extension, but, to date, the record has not been filed.
Because the appeal cannot proceed with an incomplete record, we ORDER Ms. Young to file the reporter's record of the February 28th proceeding no later than May 29, 2020. As we cautioned in our April 20th order, we further ORDER that Ms. Young not sit as a reporter until she has filed the record.
We DIRECT the Clerk of the Court to send a copy of this order to the Honorable Dale B. Tillery, Presiding Judge of the 134th Judicial District Court; Tina Thompson, as the Official Court Reporter for the 134th Judicial District Court; Ms. Young; the Dallas County Auditor; and, the parties.
