ORDER


Presently pending in this § 1983 action brought by a Georgia prisoner is the plaintiff's motion for an extension of time so that he may learn the home office address and the names of the key officials of the defendant, Southern Health Providers. On August 2, 2005, subsequent to an initial review of the complaint, the undersigned recommended that Southern Health Providers be dismissed as a defendant as that entity is not a proper defendant in a § 1983 action. For this reason plaintiff's motion for an extension of time is DENIED without prejudice to his right to re-file same in the event that the District Judge does not adopt the recommendation with respect to Southern Health Providers.

SO ORDERED.
