For the reasons assigned in Marbury v. Arnold and New Amsterdam Casualty Company, 142 So.2d 507, No. 5551 of the Docket of this Court, the judgment appealed from is reversed and plaintiff's suit dismissed at his costs.

Judgment reversed.
