Powell v. Allen

District Court of Appeal of Florida, Fifth District
Jan 14, 2000
748 So. 2d 376 (Fla. Dist. Ct. App. 2000)

Opinion

No. 5D99-2321.

Decision filed January 14, 2000.

Petition for Certiorari Review of Decision from the Circuit Court for Volusia County, Acting in its Appellate Capacity.

Thomas D. Wright, New Smyrna Beach, for Petitioner.

Peter J. Snyder of Peter J. Snyder, P.A., Boca Raton, for Respondent.

DENIED.

GOSHORN and HARRIS, JJ., concur.

GRIFFIN, J., dissents, with opinion.

I respectfully dissent. This is an action for recission or cancellation of a contract for the purchase of goods. The analysis of the venue issue in this case set forth in the county court's order of April 27, 1998, is correct. It is unclear to me why the circuit court and the majority have ignored it.
