Cohen ( ante, p. 709), decided herewith. Lazansky, P.J., Young, Hagarty and Carswell, JJ., concur; Scudder, J., dissents upon the grounds stated in his dissenting memorandum in Poughkeepsie Savings Bank v. Cohen ( ante, p. 709).
