Jimmy POTHITAKIS, Appellant v. UNITRIN SAFEGUARD INS. CO, Appellee
From the County Court At Law No. 10, Bexar County, Texas Trial Court No. 2020CV02127 Honorable Cesar Garcia, Judge Presiding
Sitting: Rebeca C. Martinez, Chief Justice Patricia O. Alvarez, Justice Lori I. Valenzuela, Justice
ORDER
LORI I. VALENZUELA, JUSTICE.
On May 1, 2024, this court issued an opinion and judgment dismissing this appeal for want of prosecution. On May 13, 2024, appellant filed a motion for rehearing. On May 28, 2024, this court denied the motion for rehearing. On June 12, 2024, appellant filed a second motion for rehearing.
Our plenary power expires on June 27, 2024; therefore, we presently retain jurisdiction over this appeal. Tex.R.App.P. 19.1. However, appellants motion for rehearing was due to be filed within fifteen days of the judgment. Tex.R.App.P. 49.1. Although appellant's original motion for rehearing was timely filed, his second motion for rehearing was not. The Texas Rules of Appellate Procedure only authorize further motions for rehearing in limited circumstances not present here. See TEX. R. APP. P. 49.4. BECAUSE APPELLANT'S MOTION FOR REHEARING IS NOT AUTHORIZED BY THE RULES, THE MOTION IS DENIED.
