ORDER

This case for the redetermination of a deficiency, presently set for trial during the Dallas, Texas, trial session scheduled to begin on Monday, October 30, 2023, is before the Court on respondent's motion to dismiss for lack of jurisdiction, filed July 28, 2023, and amended on July 30, 2023.

Premises considered, it is

ORDERED that respondent's motion, as amended, is set for hearing at the place shown in the Notice Setting Case for Trial, served June 13, 2023, at a time and date certain of 10 a.m. on Wednesday, November 1, 2023.

The parties need not comply with the obligations imposed upon them in the Standing Pretrial Order, served June 13, 2023, and are excused from appearing on Monday, October 30, 2023, as previously directed. Petitioners are advised that the failure to attend the hearing could result in the dismissal of the case as requested by respondent and the assessment of the deficiency determined in the notice of deficiency that forms the basis for this case.
